(Keep in mind, potential SPOILERS for Captain America: Civil War!!!)

Everyone is exited for [Captain America: Civil War](tag:994409), right? I mean, it's like Avengers 2.5. It's gonna be awesome. One question does linger though: Who creates the Superhero Registration Act? Well, Here's my theory.

So we know from the Civil War comic that the government creates the Superhuman Registration Act so that heroes known and unknown would have to register and turn themselves in to the government and then they would be protected. Those who resisted would be branded as fugitives and would be forced into hiding. Well what if instead of the government creating the Registration Act, what if it was...

Duh, duh, DUH!!!!!!!!!!!!!!!!!!!!

HYDRA!

Hail HYDRA!
Hail HYDRA!

That's right! The Nazi splinter-group creates a bill that forces super humans to register under the government. It makes sense. It definitely seems like something they would do. Captain America always spouts that the government should never infringe on our rights, and HYDRA has been trying to take over the world since World War 2. What better way to take over the world than to round up a bunch of super humans and make them do whatever you tell them to do in return for protection. And then they can kill whoever opposes them or who escapes registration. They have a whole team of super-powered people so really no one but other equally powered people can stop them. It's already been confirmed that Baron Zemo will be in Civil War so HYDRA will be in the film.

If The Winter Soldier taught us anything it's that HYDRA has already infiltrated the government. But you might say, "But that was only S.H.I.E.L.D.!" Well if you remember from The Winter Soldier Senator Stern was arrested for being affiliated with HYDRA. A sitting U.S. senator elected by the American people was a HYDRA member. There is reason to believe that other senators could be affiliated with HYDRA. Congress, The House of Representatives, the Speaker of the House, the Vice President, or even the President himself! Anyone with a sitting seat in the government could be a HYDRA agent. And before you ask about Iron Man and his team being for registration and it being a HYDRA legislature, Iron Man either doesn't know or is so wanting to fix what happened with Ultron that he doesn't look into any possible flaw with the plan. So if HYDRA is still in the government the Registration Act is a perfect way for them to achieve their goal of conquering the world.
