Kelly Rutherford has tragically lost custody of her children after a six year long bitter court battle between the 47-year-old actor and her former husband, Daniel Giersch.
In an even more saddening blow, it has been reported that the Gossip Girl star has been prevented from ever bringing her two children, Hermes and Helena, into the United States again; and she will be forced to leave the country in order to visit them in Monaco where they will reside with their father.
This harsh decision is probably due to the fact that she violated a previous custody agreement after the children spent the summer with her in New York and she neglected to put them on a plane back to Monaco, as previously agreed. Rutherford later claimed this was because she was confused about which court authority to believe, she explained:
"These past three years waiting for my children to come home have been very difficult. My children were forced to leave the United states in 2012 when they were only 2 and 5 years old. In May, a judge in California gave me sole custody and brought them home. I am immensely grateful and overjoyed to have them back. Since May, however, the court proceedings have been confusing."
Rutherford first lost custody of her children in 2012 during a court battle that she describes as:
"Shocking, illegal and abusive. It was the most cruel act against a child I have ever witnessed in my entire life."
Kelly and her ex-husband have been embroiled in a vicious battle since before their divorce was finalized in 2009, when she was pregnant with Helena.
While both adults have clearly been at fault here, they have almost certainly been driven to do so by their genuine love of their children. Despite this, I can't help but think how the kids feel about their current position and wonder whether their voices are being heard over the clamor.
They are the real losers here.
